Introduction

Welcome to Delta Survival School s.a.r.l (referred to as "Delta Survival School," "we," "us," or "our"). By accessing and using our services, you agree to comply with the following terms and conditions.

1. Interpretation and Definitions

1.1 Interpretation: Words with an initial capital letter have specific meanings defined below. These definitions shall apply regardless of whether they appear in singular or plural form.

1.2 Definitions:

  • Company (referred to as "the Company," "We," "Us," or "Our" in this Agreement) refers to Delta Survival School.

  • Country refers to Luxembourg.

  • Feedback means feedback, innovations, or suggestions sent by You regarding our Service.

  • Service refers to the Website and all services offered by Delta Survival School.

  • Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

2. Acknowledgment

2.1 These Terms and Conditions govern the use of our services and form the agreement between You and Delta Survival School. By accessing or using our services, You agree to comply with these Terms.

2.2 If You disagree with any part of these Terms, please do not use our services.

3. Payment Terms

3.1 Payment Methods: We accept various payment methods, including credit cards (Visa, MasterCard, American Express), PayPal, and bank transfers. All payments are due at the time of booking.

3.2 Deposits and Deadlines: For courses, seminars, workshops, and expeditions, a non-refundable deposit may be required to secure your booking. Full payment must be received by the specified deadline.

3.3 Late Payments: Failure to make payment by the specified deadline may result in the cancellation of your booking without refund.

4. Cancellation Policies

4.1 Personal Training Cancellation Policy

  • Sessions must be canceled at least 24 hours in advance; otherwise, the session will be counted, and the customer will be charged.

  • No refunds will be given for any purchased packages. If a customer moves away after purchasing a package, the remaining sessions are non-refundable as a free trial session was provided beforehand.

4.2 Courses, Seminars, and Workshops Cancellation Policy

  • Cancellation by Participant: All cancellation requests must be submitted in writing via email to contact@deltasurvivalschool.com.

  • Cancellation Fees:

    • More than 30 days before the start date: Full refund minus a 10% administrative fee.

    • 15 to 30 days before the start date: 50% refund of the course fee.

    • Less than 15 days before the start date: No refund.

  • Substitution Policy: Participants may substitute another individual in their place without penalty, provided Delta Survival School is informed at least 5 days before the start date.

  • Cancellation by Delta Survival School: If Delta Survival School cancels any course, participants will receive a full refund or the option to transfer to another course of equal value.

4.3 Survival Expedition Cancellation Policy

  • Cancellation by Participant:

    • More than 2 months before the expedition start date: Full refund minus a €150 administrative fee.

    • Less than 30 days before the expedition start date: 50% refund of the total cost.

    • 15 days or less before the expedition start date: No refund.

  • Cancellation Due to Accidents or Emergencies: Participants may cancel due to a serious accident or medical emergency with documented proof (e.g., doctor’s note). Refunds will be processed within 30 days of the cancellation request.

  • Accidents During Expedition Preparation Process: If an accident occurs during the official preparation, our insurance will cover the issue. For accidents due to personal activities, refunds will depend on the time frame and circumstances, as outlined above.

  • Substitution Policy: Participants may transfer their registration to another individual without penalty if Delta Survival School is informed at least 5 days before the start date.

  • Cancellation by Delta Survival School: If Delta Survival School cancels the expedition, participants will receive a full refund or the option to transfer their registration to a future expedition date.

5. Health and Fitness Requirements

5.1 Participants must meet certain health and fitness requirements to join courses, workshops, and expeditions. Delta Survival School may require a medical certificate or fitness assessment to confirm eligibility.

5.2 You are responsible for consulting a physician before participating to ensure you are physically fit and capable of engaging in survival training and activities.

6. Waivers and Liability

6.1 Assumption of Risk: By participating in any activities or services offered by Delta Survival School, You acknowledge that such activities may involve inherent risks, including injury, illness, or death. You voluntarily assume all risks associated with participation.

6.2 Release of Liability: To the fullest extent permitted by law, Delta Survival School shall not be liable for any injury, loss, or damage, including direct, indirect, incidental, or consequential damages arising from participation in any activity, course, seminar, or workshop.

6.3 Waivers: Participants may be required to sign a waiver and release form prior to participation. Failure to do so will result in cancellation of participation without a refund.

7. Data Protection and Privacy

7.1 All personal data collected by Delta Survival School will be handled according to our Privacy Policy, which complies with applicable data protection laws. We do not share personal data with third parties except as necessary for the provision of services.

8. Marketing and Media

8.1 Delta Survival School reserves the right to use photos or videos taken during courses, workshops, and expeditions for marketing purposes. If You do not wish to appear in such media, please notify us in writing before the start of the activity.

9. Dispute Resolution

9.1 Any disputes arising from these Terms or the use of our services shall first be attempted to be resolved informally by contacting Delta Survival School.

9.2 If informal resolution is not possible, the dispute shall be settled through mediation or arbitration in Luxembourg, following the laws of Luxembourg.

10. Refunds and Rescheduling Due to Force Majeure

10.1 Delta Survival School is not liable for cancellations or rescheduling due to force majeure events, including natural disasters, pandemics, or other events beyond our control.

10.2 Refunds or rescheduling options for such events will be at the sole discretion of Delta Survival School.

11. General Provisions

11.1 Late Arrivals or Early Departures: Participants who arrive late or leave early for any service, including courses, workshops, or personal training, will not receive a refund or rescheduling for missed time.

11.2 Amendments: Delta Survival School reserves the right to amend these Terms at any time. Any changes will be communicated to participants and apply to future enrollments.
